1. Acceptance of Terms
By signing up to base and completing your registration, or execution of a counterpart signature page hereto, you indicate your acceptance of this agreement and agree to abide by the terms and conditions set forth herein. If you are entering into this agreement on behalf of a business or other legal entity, you hereby represent and warrant that you have the authority to bind such entity and its affiliates to the terms and conditions of this agreement, in which case “you” or “your” shall refer to such entity and its affiliates. If you do not have such authority, or if you do not agree with the terms and conditions of this agreement, you may not accept this agreement nor may you use the base platform or receive services hereunder.
2. Description of Service.
The “Service” includes access to (a) the Site, (b) the on-demand Stingo business productivity system, tools and services provided through the Site, (c) configuration, setup and training services, if You purchase such services; and (d) all software, data, text, images and content made available through the Site.
3. General Conditions/ Access and Use of the Service.
Subject to Your compliance with this TOS, Insightly grants You a limited, non-exclusive, non-transferable, non-sublicensable license to download, view, copy, display and print the Content solely in connection with Your permitted use of the Service and solely for Your internal business purposes.
You understand that the technical processing and transmission of the Service, including Your Content, may be transferred unencrypted and involve (a) transmissions over various networks; (b) changes to conform and adapt to technical requirements of connecting networks or devices and (c) transmission to Insightly’s third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate and maintain the Service.
4. Provision of the Platform
Registration. You must be to register, and must provide complete and accurate information during the registration process, including a valid credit card number that You are authorized to use if You are registering for a paid Subscription.
Free Trial. Base may make all or part of the Base Platform available to You and Your End Users on a trial basis free of charge (the “Free Trial”). The Free Trial shall begin when You submit a registration for the same to Base, and shall terminate on the earlier of (i) the Free Trial expiration date as specified by Base upon receiving your registration, or (ii) the date You execute an Order Form for a Subscription under this Agreement. NOT WITH STANDING SECTION 11, ACCESS TO THE BASE PLATFORM IS PROVIDED “AS-IS” AND WITHOUT WARRANTY OF ANY KIND DURING THE FREE TRIAL. YOUR DATA ENTERED, AND ANY SPECIFIC SETTINGS OR PREFERENCES YOU OR YOUR END USERS MAKE, DURING THE FREE TRIAL WILL BE PERMANENTLY DELETED UNLESS YOU PURCHASE A SUBSCRIPTION OR EXPORT SUCH DATA/SETTINGS PRIOR TO THE EXPIRATION OF THE FREE TRIAL.
5. How We Collect Information from You
As a data controller, Stingo collects the following personal information from you:
i. Name, address, telephone number, email address and business details when you/your employer creates an account.
ii. Communications with us e.g. comments, suggestions, a request for information about our products and services or any other correspondence or phone calls.
iii. Interactions with third-party service providers, marketing partners and affiliate interactions including Google Analytics, Google Adwords, Facebook Ads, Indiamart, TradeIndia, Capterra, and Rozarpay etc.
iv. We collect location based data (GPS coordinates) through our geolocation feature when your employer requires users to log their GPS location. Our application uses Mapbox API(s) to provide location-based services. By using our Services, you acknowledge that your data may be processed in accordance Privacy Policy.
v. For marketing purposes we take note of the marketing channels and campaigns that drew you to Stingo.
vi. Processing your data in the way explained above is necessary for us to provide Stingo services to users.
